Welcome to Promptsity, a U.S.-based AI prompt marketplace that allows creators to sell digital prompts and buyers to license them for personal or commercial use. By accessing or using our website (the “Site”), you agree to be bound by these Terms and Conditions (“Terms”).

1. Eligibility

You must be at least 18 years old to use this site. By using Promptsity, you affirm that you are legally able to enter into a binding contract.

2. User Accounts

You are responsible for maintaining the confidentiality of your account login and are liable for all activities conducted under your account. Notify us immediately if you suspect unauthorized use.

3. Marketplace Usage

a. Buyers:

• You are purchasing a license to use the prompt(s), not ownership.
• Usage rights depend on the license terms stated in the product listing (e.g., personal use, commercial use, or resale rights).
• You may not resell or redistribute prompts unless explicitly granted resale rights.

b. Sellers:

• You must only upload original content or content you have full rights to sell.
• You grant Promptsity a non-exclusive right to display and market your prompts on our platform.
• You are responsible for accurately describing the license rights associated with your product.

4. Payments and Fees

Promptsity takes a percentage commission from each sale (as outlined on our seller dashboard). Buyers are responsible for ensuring payment details are correct. All prices are listed in USD

5. Refunds

Due to the nature of digital products, all sales are final unless otherwise stated. Refunds are only granted in cases of technical error or duplicated charges. For refund inquiries, email us at Promptsity@gmail.com.

6. Intellectual Property

All content on this site, including branding, design, and functionality, is owned by or licensed to Promptsity and protected under U.S. and international copyright laws. Unauthorized use is prohibited.

7. Prohibited Activities

• Upload or sell AI-generated content you did not create or do not have commercial rights to distribute.
• Sell prompts copied from other creators, platforms, or communities without permission.
• Mislead users about what your prompt creates or how it works.
• Use the marketplace to facilitate fraud, scams, or any illegal activity.
• Attempt to bypass our payment system or conduct sales off-platform to avoid fees.

Note: Promptsity fully supports and encourages the use of AI tools — but we expect honesty, originality, and transparency in how your content is created and sold.

8. Limitation of Liability

Promptsity is not liable for any indirect, incidental, or consequential damages from use of the platform. Use at your own risk.

9. Modifications

We reserve the right to update or modify these Terms at any time. Updates will be posted on this page with a new effective date.

10. Governing Law

These Terms are governed by the laws of the United States and the State of [You’re Based In, e.g., California or New York], without regard to its conflict of law principles.
